Scott J. Farrell is Of Counsel to the Firm and handles both civil litigation and corporate law in New York, as well as corporate and securities class action litigation, shareholder derivative matters, and counseling the firm’s clients on complex electronic discovery matters. He has extensive experience in all phases of litigation, including arbitration and trial, and, over the course of his career, has successfully represented a diverse clientele in a broad range of complex legal disputes, in federal and state courts across the country.
Mr. Farrell graduated Yeshiva University, magna cum laude, in 1996, where he was a Gruss Scholar and was awarded a Max Stern Scholarship, the school’s highest honor afforded incoming students. He also graduated New York University School of Law in 1999, where he served as Articles and Notes Editor of the Journal of Legislation and Public Policy.
Upon his graduation from law school, Mr. Farrell served as an associate in the litigation department of Rosenman & Colin LLP (now Katten Muchin Rosenman LLP). Thereafter, he served as a litigation associate and partner, respectively, at two leading national plaintiffs’ class action firms, where his practice consisted of ERISA, securities, consumer protection and antitrust class action litigation, as well as general commercial litigation.
Mr. Farrell co-authored the articles “Electronic Discovery and Vanishing Text Messages,” New York Law Journal, April 14, 2011, “Taming the Metadata Beast,” New York Law Journal, May 16, 2008, and “In re Gary Glass and Zoltan Guttman,” Futures & Derivatives Law Report, July/August, 1998. “Taming the Metadata Beast” has been cited in numerous federal cases (including one authored by now-retired District Court Judge Shira A. Scheindlin, of the Southern District of New York), articles, law reviews and treatises. He has also been published in FYI Magazine in a series of articles featuring the lighter side of the law, including: “Professional Regret?,” February 2016; Risk vs. Reward: A Cautionary Tale About (Not Just) ChapStick®, March 2016; and “In G-d We Trust” [Or, Thinking Outside The Box], April 2016.
Mr. Farrell has also guest lectured at the law school and collegiate levels, most recently at University of Pittsburgh School of Law, “Precedential “Appeal”: Tactical Use of Precedent At The Trial And Appellate Levels,” October 2016, and at Touro-Lander College For Women, “Class Actions, And Evolution Of Accountants’ Liability After Stoneridge Investment Partners V. Scientific Atlanta And Related Supreme Court Decisions, OR, Why And How People Sue Accountants,” January 2016. He was also a featured faculty member on Lawline.com, an accredited CLE provider, where he was a co-presenter of “Technology and Your Practice: Electronic Discovery, Other ESI Issues, and Reflections on 2009 Developments.” He is a former member of The Sedona Conference Working Group on Electronic Document Retention and Production.
Mr. Farrell is a member of the bar of the States of New York and New Jersey and is also admitted to practice in the United States District Courts for the Southern and Eastern Districts of New York, the Districts of New Jersey and Colorado, the Western District of Tennessee and the United States Court of Appeals for the Second Circuit.
